I. TENURE TRACK APPOINTMENTS

The appointment of a University faculty member in a position with tenure shall be deemed to be continuous in nature, except that (a) if the appointment is conditional it shall terminate upon the occurrence of the specified condition and (b) the appointment shall be subject to termination in accordance with established policies, practices and procedures of the University with respect to tenure. The appointment of a University faculty member without tenure in a position that is tenure-generating (tenure track) shall be deemed to be continuous in nature except that (a) if the appointment is conditional it shall terminate upon the occurrence of the specified condition and (b) the appointment shall be subject to review, non-retention and termination under established policies, practices and procedures of the University with respect to non-tenured faculty. Unless otherwise specified at the time of appointment, the appointment of the faculty member in a position that is not tenure-generating (not tenure track) shall terminate on or before June 30 following the date of the appointment, subject to renewal except as otherwise provided in applicable University policies and regulations.

II. ROLLING APPOINTMENTS

In situations where a programmatic need cannot be met through normal tenure track hiring procedures, a department may be allowed, upon recommendation of the dean and approval of the provost, to use a two- or three-year, non-tenurable, rolling appointment. A candidate hired into such a position would initially be placed on a one-year renewable contract and would have to serve a minimum of three years before becoming eligible for a two- or three-year contract.

Each year the department chair and dean shall review both the candidate and the need for the position before deciding whether or not to terminate. If the decision is to terminate, the candidate must be notified by June 30, or, in the case of an appointment expiring during an academic year, by the anniversary date of the appointment. Otherwise, the candidate will receive a new contract. That contract will be a one-year contract during the probationary period and a two- or three-year contract commencing with the start of the fourth year.

If an individual holding a rolling two- or three-year appointment transfers to a tenure track position, a maximum of three years credit may be applied toward tenure.

To fill a position of this type, a department should determine an appropriate job description and appropriate credentials and then follow the procedures of PPM 8-6. Contracts for such positions should be written so that candidates understand and agree that there is no de facto tenure associated with the position and that they can be terminated upon the expiration of their contract.
