II. POLICY
A. In compliance with the Fair Labor Standards Act, Weber State University will designate all employment positions as either exempt or non-exempt from the overtime provisions of the ACT. In general, Professional positions will be structured to qualify as exempt positions. In some cases, however, Weber State University may view a position as being professional in nature that cannot qualify as such under the Fair Labor Standards Act. In such cases, the University will, after appropriate analysis and upon the recommendation of the director of Human Resources, designate the position as Professional Non-Exempt.
B. Professional Non-Exempt employees receive the same status, guidelines, privileges and benefits granted to Professional employees with the following exceptions:
1. Professional Non-Exempt employees are subject to the overtime regulations of the Fair Labor Standards Act and are covered by Weber State University PPM 3-18 dealing with overtime and compensatory time.
2. Supervisors of Professional Non-Exempt employees may take into account the amount of overtime allowed when considering the granting of other additional pay opportunities such as external consulting. External consulting time does not count as time worked for the University when computing overtime eligibility.
3. Professional Non-Exempt employees may not work more than 40 yours per week without prior approval of the immediate supervisor.
